Structured Asset Funding, LLC attended the 2009 National Association of Settlement Purchasers (“NASP”) Annual Affiliates’ Conference in Las Vegas November 11th and 12th. NASP board members, its officers and in house lawyers were all in attendance. Additionally, outside counsel for all NASP members were invited to become associate members of NASP and attend the legal conference where timely and relevant structured settlement topics were presented to benefit both NASP members, and practitioners alike in their structured settlement transfer practices.
This year’s conference provided information in the form of lectures, presentations, panel discussions and question and answer sessions on a variety of legal and business matters relevant to current trends in the structured settlement transfer business. On the first day, presentations included legislative developments, legal case updates, a panel discussion on miscellaneous issues facing the industry and a very extensive overview of the developments in California in 2008/2009. Josh Tobin, Chief Financial Officer at Structured Asset was involved in a panel discussion regarding the impact of the 2008/2009 Capital Markets and the issues it caused on the structured settlement purchasing market. The afternoon session had a very informative panel, including members of the judiciary and outside counsel regarding court practices and issues that can arise in transfer matters. All agreed that the comments from the judiciary provided very helpful insight into what it takes to get a transfer approved. The day ended with a very special presentation of the “Hamilton Award” by NASP to Assemblyman Van Tran of California, in recognition of his outstanding work on behalf of annuitant’s rights to transfer structured settlement payment rights.
Day two provided a very interesting panel discussion that was moderated by Pat Hindert of S2KM/TSSG (http://s2kmblog.typepad.com/rethinking_structured_set/daniel_hindert/) and Earl Nesbitt, counsel for NASP from the law firm of Nesbitt, Vassar, McCown & Roden. The panelists included, among others, Jeremy Babener, a distinguished writer about industry issues, along with our own Andrew Savysky, President of Structured Asset, Dan Hindert of Parsons, Behle & Letimer, Richard Risk of the Risk Law Firm and from the primary market, Michael Upchurch of Delta Settlements. The topic was “Rethinking Structured Settlements” and the speakers presented a very impressive and stimulating talk including recounting developments in 2009 that affected the structured settlement industry, the best and worst structured settlement business practices, and how public opinion supports court ordered structured settlement sale transactions.
The conference was enjoyed by all and attendees came away with a better understanding of many issues facing the industry and how these will be handled in the future, obtained from experts with vast diversity in the overall industry and in their opinions.
